PENALTIES AND DISQUALIFICATION TO PHYSICIANS THAT PERFORM BARIATRIC SURGERIES


Currently, there are only 88 specialists in this type of surgery in Mexico; public and private entities that allow it would also be sanctioned.

In order to prevent uncertified physicians from performing bariatric surgery, Congressman Yerico Abramo Masso of the PRI Parliamentary Group presented an initiative to reform and add a paragraph to article 421 of the General Health Law.

It establishes an equivalent fine of 12 thousand and up to 16 thousand times the unit of measure and disqualification from seven to ten years from their employment, profession or public office, to anyone who violates the provision; Or the cancellation of Medical Licensed with Patent Effects, the respective concession or authorization as the case may be, without affecting the right of the affected party to file a complaint about the crime or offenses in question.

In addition, a fine equivalent to 25 thousand and up to 34 thousand times the unit of measurement and updating in question will be sanctioned to public or private entities that provide health services, within which special medical surgical procedures are performed Of physicians who lack certification.

Currently there are 88 certified bariatric surgeons in Mexico; however, there are those who unduly carry out the aforementioned surgeries without having the specialty.
